Life Elevated Inc. Privacy Policy

1. Summary

Life Elevated Inc. (“Life Elevated”, “we”, “our”) understands the importance of protecting your personal information. We have created this Privacy Policy in order to explain our practices concerning the collection, use, disclosure, retention and protection of your personal information.

We only collect your personal information for specific business purposes. We limit access to your personal information, through physical, electronic and procedural safeguards, to those persons who require it to provide our services and products. When we provide access to your personal information, it is for a legitimate business purpose or reason and in accordance with this Privacy Policy. Our employees, and others, who may have access to your personal information are governed by standards and policies to ensure the security and confidentiality of your personal information. We treat and safeguard personal information collected through our web pages the same way as personal information that we collect through other means, such as customer contracts.

Before you use our website, Caremate Service, or other services from Life Elevated, we request that You read this Privacy Policy (and our Terms of Use Agreement), and understand what personal information we collect, how we use it, and how we disclose it.

By visiting our website, or using our services or software, and any other linked pages, features, content, devices or application services offered from time to time by Life Elevated in connection therewith (collectively, the "Service(s)"), You acknowledge that you accept the practices and policies outlined in this Privacy Policy, and give us your consent to collect, use and disclose your personal information, as documented in this Privacy Policy.

Life Elevated’s Privacy Policy is based on the Personal Information Protection and Electronic Documents Act (the “Privacy Act”), which is a Canadian law relating to data privacy. It governs how private-sector organizations collect, use and disclose personal information in the course of commercial business In addition, the Privacy Act contains various provisions to facilitate the use of electronic documents, and to promote consumer trust in electronic commerce.

Life Elevated adheres to the 10 principles of the Personal Information Protection and Electronic Documents Act when collecting, using and disclosing personal information in the course of commercial activity. The following gives a brief description of each principle:

Accountability: An organization is responsible for personal information under its control and shall designate an individual or individuals who are accountable for the organization’s compliance with the following principles.

Identifying Purposes: The purposes for which personal information is collected shall be identified by the organization at or before the time the information is collected.

Consent: The knowledge and consent of the individual are required for the collection, use or disclosure of personal information, except where appropriate.

Limiting Collection: The collection of personal information shall be limited to that which is necessary for the purposes identified by the organization. Information shall be collected by fair and lawful means.

Limiting Use, Disclosure, and Retention: Personal information shall not be used or disclosed for purposes other than those for which it was collected, except with the consent of the individual or as required by law. Personal information shall be retained only as long as necessary for the fulfillment of these purposes.

Accuracy: Personal information shall be as accurate, complete, and up-to-date as is necessary for the purposes for which it is to be used.

Safeguards: Personal information shall be protected by security safeguards appropriate to the sensitivity of the information.

Openness: An organization shall make readily available to individuals specific information about its policies and practices relating to the management of personal information.

Individual Access: Upon request, an individual shall be informed of the existence, use and disclosure of his or her personal information and shall be given access to that information. An individual shall be able to challenge the accuracy and completeness of the information and have it amended as appropriate.

Challenging Compliance: An individual shall be able to address a challenge concerning compliance with the above principles to the designated individual or individuals accountable for the organization’s compliance.

2.0 Definitions

The following definitions are to assist in the interpretation of this Privacy Policy and are subject to change given amendments to applicable legislation:

  1. "collection" means the gathering, acquiring, recording, or obtaining of personal information from any source, including third parties, whether written or verbal;

  2. "consent" means voluntary agreement for the collection, use and disclosure of personal information for defined purposes. Consent can be either expressed or implied and can be provided directly by the individual or by an authorized representative. Express consent can be given orally, electronically or in writing, but is always unequivocal and does not require any inference on the part of Life Elevated. Implied consent is consent that can reasonably be inferred from an individual's action or inaction;

  3. "commercial activity" means any particular transaction, act or conduct or any regular course of conduct that is of a commercial character, including the selling, bartering or leasing of donor, membership or other fundraising lists;

  4. "disclosure" means making personal information available to a third party;

  5. "personal information" means any information that identifies you, or by which your identity could be deduced. (It does not include information contained in public records, and it does not include the name, title or business address or telephone number of an employee of an organization);

  6. "record" includes any correspondence, memorandum, book, plan, map, drawing, diagram, pictorial or graphic work, photograph, film, microfilm, sound recording, video-tape, machine-readable record and any other documentary material, regardless of physical form or characteristics, and any copy of any of those things;

  7. "third party" means an outside individual or organization that is hired to carry out Life Elevated business objectives.

3.0 Personal Information Collected, And How It Is Handled

This section describes what personal information is collected, how it is collected, the purpose for the personal information (how it is used), and how it is disclosed:

Note:We may use third party computer hosting companies to run our website and computer applications on their computer servers. And to store personal information on their servers. These third party computer hosting companies will not use personal information for any purpose.


4.0 Life Elevated’s Compliance With The 10 Principles

This section describes how Life Elevated complies with the 10 principles of the Privacy Act.

4.1 Accountability

Life Elevated takes responsibility for personal information under its control. This consists of personal information that is held by our organization, and personal information that is transferred to a third party for storage or processing.

We have taken all reasonable steps required to protect your personal information from unauthorized access, use or disclosure.

We have designated a Privacy Officer who is accountable for the organization’s compliance with the principles of the Privacy Act.

All Life Elevated employees, who collect, maintain and/or use personal information, are responsible for insuring that the collection, use and disclosure of this information is carried out in accordance with this policy and relevant procedures.

4.2 Purpose For Collecting Personal Information

Life Elevated collects personal information for the purpose of carrying out specified business purposes/operations, unless otherwise authorized by the Privacy Act.

We collect personal information for the following purposes (including, but not limited to):

  • Enable us to provide various services to you, including the Caremate Service
  • Ensure that we provide quality customer service to you
  • Process and track payments associated with your account
  • Help us improve our website, and our services to you
  • Enable us to notify you of special offers, of new products and services, and other information of interest.

Section 3.0 (Table 1) indicates what specific personal information is collected, how it is collected, the purpose for collecting this personal information, and when the information is collected.

In addition, section 5.3 gives details on our use of third parties, and what personal information, if any, we share with them.

Life Elevated informs You as to why specific personal information is needed, and how it is used, before we collect this personal information. We do this by requesting that You read this Privacy Policy document before using the website, the CareMate Service, or any other services of Life Elevated.

4.3 Consent

Life Elevated obtains Your consent for the collection, use, and disclosure of personal information in the following way:

  • We define what personal information we collect, the purpose for collecting the personal information, and how we disclose it, in this Privacy Policy.
  • We request that You read and understand this Privacy Policy (and Terms of Use Agreement), before using the website, CareMate Service, other services from Life Elevated.
  • If you use the website, CareMate Service, or other services you give us your consent to collect, use, and disclose your personal information, as defined in this Privacy Policy.

Where required, consent for the collection, use and disclosure of personal information may be expressly given or implied. Your express consent may be given in writing, verbally or through electronic means. Your implied consent may be given through an action you have taken, such as supplying your personal information for a specified purpose.

If you prefer that we not use or disclose your information for any of the mentioned purposes, as described in section 3.0, you may notify us in writing at any time. If you do not notify us, we will consider you to have consented to our continued use and disclosure of your personal information. A notification that we not use or disclose your personal information for certain purposes may affect our ability to provide you with services.

Circumstances when we may collect, use or disclose personal information without the consent of the individual

  1. From time to time, we may be compelled by legal action to release personal information.
  2. There may be situations where we may be permitted by law to collect, use or disclose personal information without the consent of the individual such as when collecting unpaid amounts owed or owing to us.
  3. In addition, we may be involved, from time to time, in transactions to sell parts of our business or assets or merge with other businesses. Since our customer information may be part of such transactions, we may use or disclose this information to other parties involved in the transaction.

4.4 Limiting Collection

Life Elevated only collects personal information that relates directly to a business activity of Life Elevated, unless otherwise authorized by the Privacy Act. We collect this information by fair and lawful means.

We continue to collect and update personal information throughout our relationship with you.

4.5 Limited Use, Disclosure, and Retention

Life Elevated will only use and disclose your personal information for the purpose for which it was collected, unless we obtain (explicit or implicit) consent from You, or the use or disclosure is authorized by the Act.

See Section 3.0 (Table 1) for details on what personal information we collect, how it is collected, how it is used, and how it is disclosed.

Personal information shall be retained only as long as necessary for the fulfillment of these purposes. Life Elevated will retain files (electronic and paper) containing personal information for a period of no longer than seven years. Personal information, that is no longer required by Life Elevated to fulfill the purposes for which the information was collected, will be disposed of in a manner that safeguards the confidentiality of the information. It will be electronically deleted, if in electronic form. It will be shredded and disposed of, if in paper form.

4.6 Accuracy of Personal Information

Life Elevated has an obligation to ensure that the personal information in our records is accurate, complete and up-to-date for the purposes for which it is to be used. We also rely on you to provide any updates to your information.

4.7 Safeguards

Life Elevated shall take reasonable steps to protect personal information against loss or theft, as well as unauthorized access, disclosure, copying, use or modification of personal information.

We limit access to your personal information (through physical, electronic and procedural safeguards) to those who provide our services (customer support; marketing and sales).

Personal information that is stored electronically shall be protected by electronic means (firewall, password protection, and possibly data encryption). All personal information under the custody or control of Life Elevated in written form shall be kept in locked filing cabinets and access to such files shall be limited to those employees who require access in order to complete their duties.

When we provide access to your personal information, it is for a legitimate business purpose or reason and in accordance with this Privacy Policy. Our employees and third parties who have access to your personal information are governed by standards and policies to ensure the security and confidentiality of your personal information.

Our Privacy Officer will, on a regular basis, ensure that such office policies are being adhered to and that all such personal information is being stored and safeguarded in accordance with this Privacy Policy.

The location and manner of storage and access of personal information depends on the nature of the information, which may be stored or accessed electronically or in hard copy in Canada or in other countries. Such information is subject to the laws of the country in which it is accessible or stored.

How We Safeguard Your Personal Information

This section gives details on how we safeguard specific types of personal information:

  1. Remote Access of Stored Personal Information

    Personal information (including your contact information, your senior’s contact information, and personal information associated with our Service) is protected from unauthorized access. You must enter your user ID and password to access this information.

    Note: Only share your user ID and password with people whom you trust. We are not responsible if you share your user ID and password and this results in unauthorized access of personal information. You do so at your own risk.

  2. Entering Personal Information

    When you provide us with personal information from a computer, the personal information flows from your computer to our server over a secure link. The personal information is encrypted as it flows from your computer to our server.

  3. Server Log Informantion

    Server log information will be saved on a local computer or on the computer of a third party company. This information will be protected by a computer firewall and with the use of passwords.

    In addition, individual information is not shared. Only aggregate information is shared with third parties, such as potential advertisers or potential investors.

  4. Interaction Information

    “Interaction” refers to when a customer and an employee of Life Elevated communication. For example, when a customer sends an e-mail asking a question on the CareMate Service, or when a customer speaks to a salesperson. The Life Elevated employee will create a record of the interaction by typing details of the interaction into the company’s customer relationship management system.

    The interaction information will be saved on either a local server/computer, or third party computer. We safeguard this information, as follows:

    • Information is protected by a firewall and by password.
    • Only need-to-know employees access the personal information
    • Restricted physical access to the server
    • This information is not shared externally.
  5. Financial/Accounting-Related Information

    This is personal information that is part of the company’s financial books. As with interaction information, this information will be saved on either a local server/computer, or third party computer. We safeguard this information, as follows:

    • Information is protected by a firewall and by password.
    • Only need-to-know employees access the personal information
    • Note: This information may be stored on a computer of a third party company, but the information is not shared with employees of the third party company.
    • The only third party that will have access to the personal information will be the company’s accountant.
  6. Personal Information Stored on Third Party Computers

    We may store personal information on computers of third party companies, as previously mentioned. Safeguards include:

    • These computers have firewalls. Firewalls prevent unauthorized access to your personal information.
    • Access to the personal information will be further protected by passwords.
    • Only need-to-know employees have access to this personal information.
    • Some aggregate information, stored on third party computers may be shared, but this information cannot be used to identify a person.
    • These third party companies have privacy policies that meet our requirements/standards. Third party employees do not access the personal information, nor share it with anyone; as part of technical maintenance, they may handle the personal information as data.

    Note: These third party computers may be located in the U.S. U.S. privacy laws cover the personal information. U.S. laws may enable U.S. people to gain access to personal information on the third party computers.

4.8 Openness

Life Elevated posts its Privacy Policy on its website. Our Privacy Policy provides specific information about its policies and practices relating to the management of personal information.

4.9 Individual Access

You have the right to access your personal information held by us. Whenever you want to review, verify or correct your personal information, write, e-mail or telephone us. Please be as specific as possible with your request. There is no charge for verifying or correcting your information but, depending on the circumstances, there may be a charge if you want hard copies of records. We will let you know at the time of your request if there is a charge.

In addition, upon request, in the form set out in the Life Elevated Privacy Policy, an individual shall be informed of the existence, use and disclosure of his or her personal information and may be granted access to the records of Life Elevated that may contain his / her personal information, except where permitted or required by law.

5.0 Other Personal Information Issues

5.1 Web Server Logs

Our computer servers automatically log information about visits to our website in the normal course of establishing and maintaining web connections. Server logs record statistical information, such as visitors’ IP addresses, type of operating systems, time and duration of visit, webpages requested, and identify categories of visitors by items such as domains and browser types. These statistics are reported in aggregate form, and viewed by our employees. They are used to improve our website and ensure that it provides the optimal web experience for visitors.

We do not link server log information to any other data in a way that would enable us to identify individual visitors. However, we may review server logs for security purposes, for example, to detect intrusions into our network. The possibility therefore exists that server log data, which contains visitors’ IP addresses, could in instances of criminal wrongdoing be used to trace and identify individuals. In such instances, raw data logs would be shared with appropriate investigative bodies authorized to investigate such breaches of security.

If you object to this gathering of information, you should not use or access our web pages.

This information may be shared with third parties in order to provide services to us.

5.2 Cookies

Many companies with websites make use of “cookies”. A "cookie" is a small line of data that is sent to your Internet browser from a web server and stored on your computer's hard drive. Cookies can track how and when you use a website, and which site you visited immediately before. Cookies are used to identify which areas of a website you have visited. A cookie does not damage your system and only identifies your browser, not you personally.

Companies with websites use cookies to gather aggregated information on unique visits, for the purpose of learning how visitors interact with their website, how they can improve the design and content of their website, and how to improve visitors’ experiences.

Life Elevated does not uses cookies.

Third Party Cookies

When you access a third party website from our website, that third party website may place or recognize a unique cookie on your browser.

Also, in the course of serving advertisements to this Site, our third-party advertiser may place or recognize a unique cookie on your browser. (See 5.3-6 for more information.)

You have the ability to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to use interactive features of this or other web sites that depend on cookies.

5.3 Third Party Companies and Personal Information

Life Elevated utilizes the services of certain third party companies as part of our business operations. This may require that we share personal information with a third party. The third party may handle the personal information in some way, such as storing the personal information.

This section describes: (a) which third parties we use; (b) what personal information we disclose to them; (c) what they use the personal information for; (d) how they protect the personal information; (e) what we do to protect the personal information:

1. Computer Hosting Companies

Life Elevated may use the services of computer hosting companies. We may locate/run our website, CareMate Service, and other services on computer servers that are owned by these companies, and that are physically located in the offices of these companies.

We do this as part of a business strategy. The hosting company provides:

  • The computer server equipment
  • Secure facilities to locate the equipment, include physical protection
  • Technical people who maintain the equipment, 24/7

By doing this, we do not have to buy computer servers, and we do not have to hire technical people to maintain the equipment.

These third parties do not use the personal information for any purpose; they simply store the personal information on their computer servers. In addition, technicians may handle the personal information as part of technical equipment maintenance, but again, they do not use the personal information.

The following information may be stored in the computers of third party companies:

  • Contact information
  • CareMate Service information and data
  • Server log information
  • Survey information
  • Accounting information
  • Interaction record information

Third party companies provide extensive protection of personal information:

  • Firewalls
  • User IDs and passwords
  • Physical security

Life Elevated will have Service Agreements with all such third party companies. These Service Agreements will spell out the privacy protection provided by the third parties. These Service Agreements will meet Life Elevated’s privacy standards.

The third parties may be located in the US. This means that the personal information will be subject to the laws of the US.

2. Payment Processor

Life Elevated uses the services of third party online payment processing companies. When clients pay their fees, they will do this online, using one of these payment processor companies. The client provides personal information such as contact information and credit card number directly to the payment processor company, on their own website. Life Elevated does not have access to the client’s credit card number.

Third party payment processor companies have very strict privacy policies.

3. Accountant

We make use of a third party Accountant to do the company’s accounting work. The Accountant will have access to personal information related to company finances, including some client personal information.

Our Work Agreement with the Accountant has strict confidentiality policies. And the Accountant will have high professional confidentiality standards.

4. Third Party Sales Representatives

We may use the services of third party sales representatives. They may have access to personal information of clients whom they deal with, including: contact information, interaction information, and payment information

Our Work Agreement with third party sales representatives has strict confidentiality policies.

5. Links to Third Party Websites

Our website may contain links to other sites. The owners of those sites are responsible for the privacy practices or content of those other sites. When accessing another site or service You should read the privacy policy stated on that site. We do not endorse and will not be responsible for the privacy practices on third party websites. This Privacy Policy only governs information collected in connection with our website and CareMate Service.

6. Third Party Advertising

We may make use of a Web advertising partner, such as Google AdSense to serve ads to visitors to our website. If/when this happens, the Web advertising partner will make use of “cookies”. This will enable information about your visits to this site, such as number of times you have viewed an ad (but not your name, address, or other personal information), to be used to serve ads to you. The Site may contain links to other Internet websites or advertisements for or placed by third parties. Life Elevated is not responsible for the privacy practices of such websites, advertisers, or third parties, or for the content of such sites or advertisements. It is possible that these links or advertisements, themselves, may be used by third parties or others to collect personal or other information about Site visitors. It is solely the visitors’ obligation to review and understand the privacy practices and policies of these other websites and of these advertisers and third parties.

5.4 Opt-Out Right

We occasionally may use personal information to contact customers for the purpose of sending information regarding our company, service or partners, such as promotions and events. Customers can opt-out of receiving such information from us by clicking on the “opt-out” link at the bottom of any email that we send you.

5.5 Changes To This Privacy Policy

Life Elevated may amend this Privacy Policy from time to time. If we make material changes to this Privacy Policy, we will notify You by posting an announcement on the homepage of our website or sending You an email to your currently listed email address. Subscribers are bound by any changes to the Privacy Policy when he or she uses the Services after such changes have been first posted. (Use of information we collect now is subject to the Privacy Policy in effect at the time such information is used.)

Your ongoing use of any Service or of the Site after the changes take effect signifies your agreement to the new terms.

It is your responsibility to check the Privacy Policy periodically for changes.
